This page informs you of our policies regarding your access and usage of the site and any associated services, and constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("You"), and Us. By installing, accessing or using the Site and/or its services you confirm you have read, understood, and agree to be bound by these Terms & Conditions in their entirety. If you do not agree with all of these terms, you are expressly prohibited from using the Site.

So long as you agree to and comply with these Terms, you will be granted a limited, non-exclusive, non-transferrable, revocable license to use the Site, solely for the purpose of accessing the Site. This license may be revoked at any time and for any reason, with no requirement to provide compensation or justification for such a decision.

Certain features of the Site may permit users to submit, upload, publish, broadcast or otherwise transmit content to or via our Site, including text, files, images, or other content forms. Currently, Doctors Paycheck is suitable for doctors in training in England employed on the 2016 Terms and Conditions only. Doctors Paycheck is not currently suitable to calculate pay for dentists employed on the 2016 Terms and Conditions, or doctors working in nations other than England. Locally Employed Doctors who are employed on a contract in line with the 2016 Terms and Conditions can check their pay with Doctors Paycheck. Doctors Paycheck is not able to calculate pay for doctors working on the 2002 Terms & Conditions.

The content and calculations within the site have been created through close scrutiny of the 2016 Terms and Conditions of Service, the Pay Circulars, the NHS Employers terms and conditions of service handbook and other NHS Employers pay resources. Where contractual clauses were deemed to be ambiguous we have clarified their exact meaning with NHS Employers. There are, however, certain aspects that remain open to interpretation due to a lack of clear contractual definitions or procedures. In these instances, there may be more than one correct way to calculate a given pay element. The aspects of pay calculations that we note remain open to interpretation are:

• Rounding of calculated values to the nearest pound.
• The exact form of weekend work used to calculate a LTFT doctor’s pro-rata commitment to the full-time weekend rota.
• With regards to accounting for prospective cover:
  • Deduction of days from study leave allowance if doctors have protected rostered study leave built into the rota.
  • Deduction of leave allowance if doctors are given a leave allowance in hours.
  • The length of a standard shift when multiple applicable options are rostered.

In these instances it may be possible for entities to calculate a salary differently, whilst remaining contractually correct. At Doctors Paycheck, we endeavour to utilise the most reasonable and widely accepted method in calculating these elements. If a discrepancy relating to one of these elements / ambiguities affects you, we advise you to contact your employer for clarity.

Unless otherwise stated, the Site is proprietary property of Us and all elements of the Site and services are owned by Us, controlled by Us or licensed by Us, including source code, images, tradecraft, logos, designs, functionality, algorithms, templates, domain names, branding, and other such features. The content is provided "As Is" for Your information and usage. Except as expressly indicated, no part of the Site or any of its content may be copied, republished, replicated, distributed, sold, or otherwise exploited for any commercial or research purpose whatsoever without Our prior permission. Excluding web crawlers for the purpose of site indexing for search engines, this Site and its content may not be accessed via automated scraping, especially for the purpose of downloading or copying the site in part or in whole.

We may terminate these Terms or any additional terms, or suspect or terminate your Doctors Paycheck account or your access to any service, at any time for any reason. We may add, remove, suspend, stop, delete, discontinue or impose conditions on services or any feature or aspect of the services at any time. We will take reasonable steps to notify you of termination or service changes. You may also terminate your account at any time by deactivating or deleting your account, or by contacting Us to remove your account on your behalf.

Once our relationship ends, we are not responsible for any losses you experience because of the termination of services, or for removing your data from our servers. Some terms of our agreement will apply even after our relationship ends. Upon termination of your account, any and all licenses or rights granted to you for use of the service are immediately terminated.

Upon termination of your account, we will endeavour to delete your information and account data stored on our servers, and we will not be liable to you or any third party for compensation, reimbursement, or damages for any termination of services, deletion of data, or suspension of services.

By using this site, you represent and warrant that:

1. You have the legal capacity to agree to these Terms & Conditions.
2. You will not access the site through automated on non-human means, whether through a bot, script or otherwise.
3. You will not use or attempt to use the site for any illegal, immoral, abusive, hateful, or unauthorized purpose.

Users are limited to one account per person, and the creation of multiple accounts for the purpose of exploiting Discounts or gaining additional access is strictly forbidden.

Usage of this Site is limited to one account per person, and one person per account. Using the Site for multiple people, i.e. checking the work schedules or pay calculations of more than one individual but using a single subscription, is expressly forbidden. If you wish to use the Site for multiple individuals or using multiple accounts, please get in touch to let us know, and we will arrange a multi-license exception for you.

You may manage your subscription, including cancelling your subscription, through the subscription management portal linked within your account settings, or by contacting Us to request us to modify your subscription on your behalf.

By using any paid feature of the Site, such as submitting an analysis, You waive your right to the 14-day consumer cooling off period for digital content. By waiving this right, You agree that no refund will be provided under any circumstances. Users who do not wish to waive this right are expressly forbidden from using any paid feature of the Site during the 14-day cooling off period.

No refunds will be provided under any circumstances for users found to be breaching the terms of service of the Site.

We operate an affiliate programme for the Site, which enables eligible users who join the programme to earn discounts, cash, or other benefits by referring friends and colleagues to the Site. Affiliates are granted non-exclusive, non-transferrable, royalty-free rights to use and display Our trademarks and branding for the sole purpose of affiliate marketing. Affiliate discounts and promotions may not be used in conjunction with any other discounts or promotions for a single purchase.

Affiliate commision payments will become due after 30 days of being incurred. Any due commission payments will be made net of any relevant deductions, such as unpaid subscription fees or repayment of any invalid benefits or commissions. You are solely responsible for the payment of any relevant taxes or other fees related to the commission payments. Referred users must purchase an annual subscription to qualify as a referred user and earn You commission or benefits. Any attempt to defraud the system or earn illegitimate benefits or commissions will result in termination of Your account and forefeiture of any due payments.

We reserve the right to remove Your affiliate status at any time without warning and without giving reason. If Your account is terminated in good standing, any due payments will still be made upon termination. Any account termination due to breach of these terms will result in forefeiture of any due payments.

We reserve the right to change the terms of usage at any time.

Joining the affiliate programme does not establish any kind of partnership or relationship between Us and You.

These Terms and Conditions and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision. These Terms and Conditions operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time.
